In what areas does your railway undertaking have a right to non-discriminatory treatment?
As an RU, your company has the right to non-discriminatory access to the railway infrastructure, to federally subsidised intermodal freight terminals and branch lines as well as to last-mile rail freight services. The following diagrams show the topics and processes where infrastructure managers, owners/operators of federally subsidised intermodal freight terminals and providers of last-mile rail freight services are required to treat your RU in a non-discriminatory fashion. Bei den grundsätzlichen Bedingungen des Netzzugangs hat Ihr EVU u.a. in folgenden Bereichen Anspruch auf eine diskriminierungsfreie Behandlung:
- Publikation der wesentlichen technischen Gegebenheiten der Strecke, insbesondere im Leistungskatalog und im Network Statement
- Information bei unterjährigen Änderungen der grundsätzlichen Bedingungen des Netzzugangs oder der wesentlichen technischen Gegebenheiten der Strecke

Bei den Systemaufgaben muss die Systemführerin das eigene EVU und Dritt-EVU bzw. andere Betroffene unter gleichen Voraussetzungen gleichbehandeln. Dies bedeutet u.a., dass sie alle betroffenen Unternehmen regelmässig informiert, ihnen eine Mitsprache einräumt und sie in die weitere Entwicklung einbezieht.

Wenn Ihr EVU von der kurz- und mittelfristigen Investitionsplanung einer ISB betroffen ist, haben Sie ein Recht auf Mitwirkung. Kapazitätseinschränkungen infolge Bau- und Unterhaltsarbeiten. Dies umfasst u.a. den Anspruch darauf:
- Auskünfte über die Planung von Investitionsvorhaben auf dem Netz der ISB zu erhalten (Projekte/Investitionen, die im Investitionsplan enthalten sind)
- Erläuterungen zu erhalten, weshalb gewisse Projekte/Investitionen nicht in den Investitionsplan aufgenommen wurden
- zu den Investitionsvorhaben der ISB Stellung zu nehmen

- hoisting as the main service provided

There is a legal obligation to publish the terms of use, which contain information that your RU has a right to know, namely:
- services offered
- description of the facility
- pricing and discounts
- access requirements
- capacity allocation

Your RU enjoys non-discriminatory treatment with regard to the range of services offered, e.g.:
- shunting
- technical inspections of rolling stock
- inspection of brakes
- connecting or disconnecting locomotives
- administrative services such as checking incoming/outgoing records in the cargo information system

There is a legal obligation to publish information that your RU has a right to know, namely:
- range of services offered;
- information about the formal procedure including deadlines for order placement (or cancellation) and for issuance and signature of the service agreement;
- pricing for the required resources and services, including any discounts
- any other general conditions that the client should be aware of when procuring services (e.g. place of service provision).
